Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services, websites, applications, APIs, and software offered by Quarq Labs (“Quarq”, “we”, “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old, or the applicable age of digital consent in your jurisdiction, to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Accounts
You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly at support@quarq.io of any unauthorized access.
3. Acceptable Use
You agree not to: use the Service for unlawful purposes; reverse engineer, decompile, or attempt to extract source code except as permitted by an open-source license; interfere with or disrupt the Service; use the Service to generate or distribute harmful, abusive, infringing, or otherwise objectionable content; bypass access controls; or scrape data at scale without permission.
4. User Content
You retain ownership of content you submit (“User Content”). You grant Quarq a worldwide, non-exclusive, royalty-free license to host, store, process, and transmit User Content solely to provide, secure, and improve the Service. Aggregate, anonymized usage data may be used to improve the Service.
5. AI Output
The Service may use machine learning to generate responses, summaries, diagnostics, or other outputs based on your inputs and system context. Output may be inaccurate, incomplete, or unsuitable for a particular purpose. You are responsible for evaluating output and any actions you take based on it.
6. Intellectual Property
The Service, including its software, design, and trademarks, is owned by Quarq Labs or its licensors and is protected by intellectual property laws. Open-source components are licensed under their respective licenses.
7. Beta and Early-Access Features
Some features may be offered as beta, early access, preview, or experimental. They are provided “as is”, may change or be discontinued at any time, and may be less reliable than generally available features.
8. Fees
Certain features may require payment. Fees, billing terms, and refund policies will be presented at the point of purchase. You authorize us to charge your payment method for applicable fees.
9. Termination
You may stop using the Service at any time and delete your account where account deletion is available. We may suspend or terminate your access if you violate these Terms, create risk or liability, or if required by law. Upon termination, your right to use the Service ends and we will handle your data as described in the Privacy Policy.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUARQ LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF YOUR USE OF THE SERVICE.
12. Indemnification
You agree to indemnify and hold harmless Quarq Labs and its affiliates from claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles.
14. Changes
We may update these Terms. Material changes will be posted on this page with a revised “Last updated” date, and continued use of the Service after changes become effective means you accept the updated Terms.
